These Terms & Conditions ("Terms") govern your access to and use of the SundayDriveAI website and services (the "Service"), provided by SundayDriveAI ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
SundayDriveAI provides an executive AI opportunity diagnostic that scores workflows and generates prioritized AI roadmaps. You must have authority to bind your organization (if accepting on its behalf) and be of legal age to enter a binding contract.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information and keep it current.
3. Acceptable use
You agree not to misuse the Service. You will not:
- Use the Service for unlawful, fraudulent, or abusive purposes;
- Infringe the intellectual property or other rights of any party;
- Send spam or unsolicited messages through or about the Service;
- Interfere with the security or integrity of the Service, including by introducing malware, probing, scanning, or scraping; or
- Reverse engineer, resell, redistribute, or circumvent technical limits of the Service.
4. Intellectual property
SundayDriveAI and its licensors retain all right, title, and interest in and to the Service, including software, documentation, branding, and content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Service within your subscription plan. You retain ownership of content you submit and grant us a limited license to host and process it solely to provide the Service.
5. Payment, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, cancellation, and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically for successive terms unless cancelled. See our Refund Policy for refund details.
6. Service level and warranties
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.
8. Indemnification
You agree to indemnify and hold SundayDriveAI harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
9. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; sections that by their nature should survive (IP, disclaimers, liability, indemnity, governing law) will survive.
10. AI outputs and accuracy
The Service generates suggestions and roadmaps based on your inputs. Outputs may be inaccurate or incomplete and are not a substitute for professional judgment. You are responsible for evaluating and verifying outputs before acting on them, and for ensuring you have rights to any content you submit.
11. Changes to the Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which SundayDriveAI is established, without regard to its conflicts-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.
